Sexual consent that is meaningless because the consenter has an impaired state of mind, no option to decline, or does not know what they are consenting to.

Having sex with them is very likely to still be rape and leave crippling psychological scars.

Kyle: "I found a girl at the bar who is into me. She is wasted but she said yes when I asked to fuck her"

Brian: "That's dubious consent. Her mind is impaired and she might not truly want it. You should wait until she is sober and ask again before you start your sexual relations".

Just because you regret it doesn't mean it's rape.

I was drunk and last night and had sex with this guy I thought was hot at the time but he's a douche so I'm going to say it was dubious consent.
